What is Second Look Legislation?

The Second Look Legislation was introduced in the 85th Texas legislative session in the form of House Bill 1274(Moody, Wu) and Senate Bill 556 (Rodriguez)

This legislation would change parole eligibility for certain inmates who were convicted of an offense committed when younger than 18 years of age.

This legislation would lower the mandatory minimum term before parole eligibility from 40 years to 20 years and would allow these individuals a meaningful opportunity to demonstrate to the parole board that they have been rehabilitated as well as require the parole board to consider mitigating factors during the parole hearing (For example, the fact that the inmate was a youth during the commission of the crime, family environment, trauma history, capacity for rehabilitation, etc.)

This legislation has widespread bipartisan support but did not pass in the 85th session. The legislation will be reintroduced in 2019.
